Terms of Use

1. Acceptance & scope

By downloading, installing, or using VitaminHelper or accessing this website, you agree to these Terms of Use ("Terms"). If you do not agree, do not use the app or website.

These Terms are a binding agreement between you and Yaroslav Pisotskyi ("we", "us", "Developer"), an individual developer based in Kyiv, Ukraine.

They work together with our Privacy Policy.

2. The app

These Terms apply to VitaminHelper — an AI vitamin and supplement coach with a tracker, meal-timed reminders, knowledge base, and optional lab-file assistance — on iOS and Android, and to this website.

3. Eligibility

You must be at least 18 years old. VitaminHelper processes health-related information and is intended exclusively for adult users.

4. Account

Some features require an account via Google Sign-In, Apple Sign-In, or email authentication. You are responsible for accurate registration information, credential security, and activity under your account.

Notify us immediately at vitaminhelper.app@gmail.com if you suspect unauthorized access.

You may delete your account via Settings → Delete account, or by email. See the Privacy Policy.

5. Subscriptions & payments

5.1 Auto-renewable subscriptions

Some features require a paid subscription. Subscriptions renew automatically unless cancelled before the end of the current billing period.

5.2 Apple App Store (iOS)

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscription renews unless cancelled at least 24 hours before the period ends.
• Manage or cancel in Settings → Apple ID → Subscriptions.
• If we increase prices, Apple will notify you and require consent before the new price takes effect, per Apple policy.
• Free trials convert to paid subscriptions unless cancelled before the trial ends.

5.3 Google Play (Android)

• Payment is charged to your Google Play account at confirmation.
• Subscriptions renew unless cancelled before the renewal date.
• Manage or cancel in Google Play → Subscriptions.

5.4 Refunds

Refunds are handled by Apple or Google. We cannot process refunds directly.

5.5 EU consumer rights

EU consumers have a 14-day right of withdrawal for digital content. By starting to download or use subscription content immediately after purchase, you consent to immediate performance and acknowledge that you lose the withdrawal right once performance begins.

6. AI-generated content disclaimer

VitaminHelper uses Google Gemini to generate supplement suggestions, lab reading assistance, chat responses, and related content ("AI Output").

• AI Output may be inaccurate, incomplete, or inappropriate. It is informational and educational only.
• Do not rely on AI Output for medical, legal, financial, or other critical decisions.
• AI Output does not represent the advice of a licensed professional.
• We do not guarantee accuracy, reliability, or suitability of AI Output.

8. User content

You may submit quiz answers, lab files and photos, chat messages, tracker entries, and wellness check-ins ("User Content").

• You retain ownership of your User Content.
• You grant us a limited, non-exclusive license to store, process, and transmit User Content solely to provide and improve the app (including AI processing as described in the Privacy Policy).
• You represent that you have the right to submit User Content and that it does not violate law or third-party rights.
• We may remove User Content that violates these Terms without notice.

9. Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Reverse-engineer, decompile, or disassemble the app
• Scrape or use automated tools to extract data
• Upload malicious code or harmful content
• Impersonate others or create fraudulent accounts
• Share account credentials
• Attempt unauthorized access to our systems or other accounts
• Use the app to provide medical advice to others
• Circumvent subscription or paywall mechanisms

Violation may result in immediate account suspension or termination without refund.

10. Third-party services & affiliate links

The app integrates Supabase, Google (including Gemini, Firebase, Sign-In), Apple, and RevenueCat, and may link to Amazon and iHerb.

• We are not responsible for third-party services, content, or privacy practices.
• Affiliate disclosure: Some product links in VitaminHelper are affiliate links. We may earn a commission if you purchase through these links, at no extra cost to you, disclosed under FTC and EU consumer rules.
• External links are not an endorsement of third-party products.

11. Intellectual property

The app, website, logos, design, code, and related intellectual property are owned by Yaroslav Pisotskyi and protected by law.

• These Terms grant a limited, non-exclusive, non-transferable license for personal, non-commercial use.
• You may not copy, modify, distribute, or create derivative works without written permission.
• "VitaminHelper" and associated logos are trademarks of Yaroslav Pisotskyi.

12. Termination

We may suspend or terminate access if you violate these Terms or if we discontinue the app. You may stop using the app and delete your account at any time. Upon termination your license ends; we delete data per the Privacy Policy (within 30 days of a deletion request); surviving clauses remain in effect.

13. Disclaimer of warranties

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAROSLAV PISOTSKYI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limits; then liability is limited to the minimum permitted by law.

15. Indemnification

You agree to indemnify Yaroslav Pisotskyi from claims arising from your use of the app, your User Content, or your violation of these Terms or law.

16. Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Mandatory consumer protection laws in the EU, UK, or other jurisdictions apply to the extent they cannot be waived.

17. Dispute resolution

Before legal proceedings, contact vitaminhelper.app@gmail.com and attempt good-faith resolution for at least 30 days.

If unresolved, disputes go to the competent courts of Kyiv, Ukraine, unless mandatory consumer law requires otherwise.

EU consumers: you may use https://ec.europa.eu/consumers/odr.

18. Changes to these Terms

We may update these Terms. Material changes will be notified via the app or email at least 30 days before taking effect where required. Continued use constitutes acceptance. If you disagree, stop using the app and delete your account.
